Nine casino resorts drive this town, and the paychecks that come off the floor rise and fall with the calendar. Roughly one in three jobs in Atlantic City is a casino job, hospitality employment here swings with the season, and the city’s median household income sits around $41,000, with about a third of residents below the poverty line. None of that is a personal failing. It’s the economy people here work in, and when a slow winter or a cut shift collides with a credit card balance, a bankruptcy lawyer is often the most affordable way out, not the last resort.

The honest answer on cost

A consultation costs nothing, fees are flat rather than hourly, and payment plans are available. Qualifying Chapter 7 filers may be eligible for the $999 flat fee. You’ll get a straight quote before you commit to anything, and nobody pressures you to file.

What filing does on day one

The moment a case is filed, federal law generally freezes collections. Garnishments stop, lawsuits pause, repossessions halt, and the phone finally goes quiet. From there, Chapter 7 typically discharges credit cards, medical debt, and personal loans within a few months, while Chapter 13 restructures what you owe into one payment sized to your actual income. And the protection has teeth: in In re Minarik (Bankr. E.D. Pa. 2025), we recovered $20,000 from PPL for a client after an automatic-stay violation.

Seasonal paychecks and the means test

Chapter 7 eligibility runs partly on a means test that averages your last six months of income. For casino and hospitality workers, that timing cuts both ways: file right after a flush summer and the average may look inflated; file after a slow stretch and it reflects reality. Tips and side income count when they’re part of your pay, and a lawyer who understands seasonal earnings can often pick a filing month that makes the difference. Have that conversation before deciding you don’t qualify.

Court is in Camden. You probably won’t be.

Atlantic City cases go to the District of New Jersey’s Camden vicinage, at the courthouse at 401 Market Street. In practice you’re unlikely to ever see the building, because 341 meetings of creditors are held by Zoom as standard practice. That means no missed shift and no drive to Camden. Everything else happens by phone and Zoom too, and the Egg Harbor Township office is about 15 to 20 minutes away when you’d rather talk face to face.

If the season took the paycheck but the bills kept coming, call (609) 808-3300. The consultation is free, it’s judgment-free, and it usually takes one conversation to know whether filing makes sense for you.

Your bankruptcy options in Atlantic City

Most people we help in Atlantic City file under one of these three chapters. Here is how each one works and who it fits.

Chapter 7

Chapter 7 bankruptcy in Atlantic City

Wipe out debt and start fresh

Chapter 7 is the fastest path to a fresh start. For most people in Atlantic City who qualify, it clears credit cards, medical bills, personal loans, and most other unsecured debt in about three to four months, and it stops collection calls, lawsuits, repossessions, and wage garnishment the day we file.

Whether you qualify depends on the New Jersey means test, which compares your household income to the state median. Most of our Atlantic City clients keep everything they own. New Jersey lets you choose the set of exemptions that protects the most, so your home, your car, and your retirement are usually safe.

Catch up and keep what you own

Chapter 13 is for people in Atlantic City who are behind on a house or a car, owe back taxes, or earn too much to qualify for Chapter 7. Instead of liquidating, you keep your property and repay what you can over a three- to five-year plan, often for a fraction of what you owe.

It is the strongest tool we have to stop a foreclosure or a repossession and make a lender accept your missed payments over time. When you finish the plan, the remaining qualifying balances are discharged.

Reorganize your business and keep operating

Subchapter V is a streamlined Chapter 11 built for small business owners. If you run a business in or near Atlantic City that is buried in lease payments, equipment loans, or merchant cash advances, it lets you reorganize that debt and keep operating, without the cost and delay of a traditional Chapter 11.

You stay in control of the business, propose a plan to repay creditors from future earnings, and in most cases keep your ownership. Mike has represented business debtors in reorganizations across New Jersey and Pennsylvania.

Common questions

I earned well all summer but I've barely worked since. Do I have to wait to file?

Not necessarily, and sometimes waiting is exactly wrong. Because the means test averages the six months before filing, a slow off-season can actually make Chapter 7 easier to qualify for. We look at your pay history and choose the timing deliberately.

Do my tips count as income in bankruptcy?

Yes. Reported tips are income for the means test and your schedules, just like base wages. What matters is documenting them accurately, which we work through with you so nothing in the paperwork comes back to bite.

Could filing cost me my casino job?

Filing alone generally can't. Federal law bars private employers from firing someone solely because they filed bankruptcy. Most employers never learn about a case at all unless a garnishment was already running through payroll, and in that situation filing is what makes the garnishment stop.

I'm a renter and I've fallen behind. Can bankruptcy help with that?

Often, yes. If your landlord hasn't yet won a judgment for possession, the automatic stay can pause an eviction, and discharging credit cards and medical debt frees up real money for rent going forward. Timing matters a lot here, so call before a court date, not after.
