1. Acceptance of Terms
These Terms of Service (“Terms”) govern your access to and use of the website located at mikeassad.law (the “Site”) and the services offered by Law Office of Mike Assad, P.C. (“Firm,” “we,” “us,” or “our”), including our Client Portal, scheduling tools, and all communications channels.
BY USING THIS SITE OR ANY OF OUR SERVICES, YOU AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE, PLEASE DO NOT USE THE SITE OR OUR SERVICES.
We reserve the right to update these Terms at any time. Changes take effect upon posting to this page with a revised date. Your continued use after any change constitutes acceptance of the updated Terms.
2. No Attorney-Client Relationship
IMPORTANT: Using this website, submitting a contact form, or sending an email to our firm does not create an attorney-client relationship. An attorney-client relationship is only formed when we have expressly agreed in writing to represent you, a conflicts check has been completed, and a written engagement agreement has been executed.
Information on this website is for general informational purposes only and does not constitute legal advice. It may not reflect current legal developments and may not apply to your jurisdiction or circumstances. You should consult a licensed attorney for advice about your specific situation.
3. No Confidentiality Before Representation
Please do not send confidential or sensitive information through our website, contact forms, or general email until you have retained our firm and we have expressly agreed to represent you. Any information submitted through the Site prior to formal representation may not be treated as confidential or privileged.
4. Client Portal (MyCase)
A. Overview
We use the MyCase Client Portal, operated by 8am, LLC, to communicate with current clients. Through the Portal, you may send and receive secure messages with our firm, view documents related to your matter, and make payments.
B. Portal Terms
Your use of the Portal is governed by both these Terms and the MyCase Client Portal Terms & Conditions, available at https://www.mycase.com/terms/client_portal/. By using the Portal, you agree to those terms as well. Please review them carefully, as they contain important provisions regarding arbitration, electronic notices, and payment services.
C. Electronic Notices
As a condition of using the Portal, you agree to receive all notices, communications, and disclosures related to the Portal and your representation electronically. You may withdraw this consent by contacting us, but doing so may affect your ability to use the Portal.
D. Account Security
You are solely responsible for maintaining the confidentiality of your Portal login credentials. You must not share your credentials with anyone. Notify us immediately at mike@assad.law if you suspect unauthorized access to your Portal account.
E. Payment Services
The Portal and our LawPay payment processing platform allow you to make electronic payments to our firm. Payments are subject to our engagement agreement and the applicable terms of our payment processors. You are responsible for ensuring that sufficient funds are available when a payment is authorized.
5. Text Message (SMS) Communications
A. Program Name and Description
Law Office of Mike Assad, P.C. SMS Messaging. We use the MyCase platform, powered by Twilio, Inc., to send clients text messages including case updates, appointment reminders, payment reminders, and other administrative communications related to your representation.
B. Consent
By providing your mobile phone number to our firm and agreeing to receive text messages, you consent to receive autodialed or prerecorded text messages from or on behalf of our firm. Standard message and data rates from your wireless carrier may apply.
C. Marketing Messages and Mobile Data Policy
We will not send marketing or promotional text messages without your prior express written consent, separate from any consent given for transactional messages. Mobile phone numbers collected for SMS communications and SMS opt-in consent will never be shared with third parties or affiliates for marketing or promotional purposes.
D. Message Frequency
Message frequency varies based on the status of your matter and your communication preferences. You can always contact us to adjust how we communicate with you.
E. How to Opt Out
Reply STOP to unsubscribe from text messages at any time, or contact us at mike@assad.law or 609-808-3300. You will receive a one-time confirmation and no further non-essential messages.
F. Help
Reply HELP to any text message or contact us at mike@assad.law or 609-808-3300 for assistance with SMS communications.
G. Compliance
Our SMS practices comply with the Telephone Consumer Protection Act (TCPA), applicable state law, and Twilio’s Terms of Service, Acceptable Use Policy, and Messaging Policy. We do not send phishing, smishing, or other prohibited message content.
H. Carrier Disclaimer
Message and data rates may apply. Carriers are not liable for delayed or undelivered messages.
6. Email Communications
A. Transactional Email
We send transactional and administrative emails — such as appointment confirmations, document delivery notices, and account-related alerts — using Postmark. These emails are a necessary part of our services.
B. Marketing Email
We may send firm newsletters, legal updates, or other marketing emails to individuals who have opted in. Every marketing email includes an unsubscribe link. You may opt out at any time by clicking that link or contacting us at mike@assad.law. Our email marketing practices comply with the CAN-SPAM Act.
C. Email Open and Link Tracking (Mailsuite)
Our firm uses Mailsuite (also known as Mailtrack), a Gmail plugin, to track when outgoing emails are opened and when links within them are clicked. This is done by embedding an invisible tracking pixel in emails sent from our Gmail accounts. By corresponding with us via email, you acknowledge that emails we send you may contain this tracking technology. Information collected includes whether and when an email was opened, your IP address, and device information at the time of opening. Mailsuite does not access or store email content. To opt out of pixel tracking, disable automatic image loading in your email client. Mailsuite’s Privacy Policy: https://mailsuite.com/en/privacy-and-security-center.
7. Online Scheduling
We use Calendly (or Acuity Scheduling) to allow clients and prospective clients to book appointments online. When you schedule through these tools, you provide your name, email address, and phone number. Use of these tools is subject to Calendly’s Terms of Service and Privacy Policy at https://calendly.com/privacy.
8. Apple iMessage and FaceTime
Our attorneys may communicate with clients via Apple iMessage and FaceTime. Both services are end-to-end encrypted, meaning Apple cannot access the content of your messages or calls. By communicating with us through these channels, you acknowledge that Apple’s Privacy Policy (https://www.apple.com/legal/privacy/) governs Apple’s handling of connection metadata associated with those communications.
9. Video Conferencing
We use Zoom and Google Meet for video consultations and client meetings. Please be aware:
- Meetings may be recorded with prior notice. We will inform you before recording any session.
- By participating, you acknowledge that Zoom Video Communications, Inc. or Google LLC may collect technical data about your participation per their privacy policies.

10. Document Delivery (DocSend)
We may use DocSend to send you documents securely. DocSend tracks basic document engagement data, such as whether a document was opened and for how long. By receiving a document through DocSend, you acknowledge that this tracking occurs.
11. Review Solicitation
We may use Reputation Stacker to request that current or former clients leave reviews on platforms such as Google, Avvo, or Yelp. Any review request will comply with applicable bar rules and FTC guidelines on testimonials and endorsements. You are under no obligation to leave a review, and declining will not affect your representation.
12. Cookies and Online Tracking
Our website uses cookies, pixels, and similar tracking technologies:
- Essential cookies — Required for site operation.
- Google Analytics / Tag Manager — Website usage analytics. Opt out at https://tools.google.com/dlpage/gaoptout.
- Meta (Facebook) Pixel — Advertising effectiveness and remarketing. Manage preferences at https://www.facebook.com/settings?tab=ads.
- Google Ads — Paid search advertising measurement and remarketing.

13. Directories and Social Media
Our firm maintains profiles on Avvo, FindLaw, Martindale-Hubbell, Yelp, and Facebook. These platforms independently operate under their own terms and privacy policies. We are not responsible for their content or practices. Information you provide on those platforms is subject to their respective terms.
14. Third-Party Services Generally
Our practice operations incorporate numerous third-party platforms. A full list with links to their privacy policies is available in our Privacy Policy at mikeassad.law/privacy-policy.
Our use of Zapier to automate workflows means data may pass between connected applications as part of automated processes. We configure these workflows to limit data exposure to only what is necessary for each task.
15. Bankruptcy and Debt Management Services
For clients in bankruptcy or debt-related matters, our firm utilizes Jubilee Pro and Stretto’s Debt Management Module (DMM). These platforms process sensitive financial and legal information. Stretto’s services involving consumer data are governed in part by the Fair Credit Reporting Act (FCRA) and the Gramm-Leach-Bliley Act (GLBA). By engaging our firm for bankruptcy or related services, you acknowledge that certain case information will be shared with these platforms as necessary to administer your matter.
16. Chapter 13 Payment Processing (TFS Bill Pay)
For Chapter 13 clients, our firm may direct you to use TFS Bill Pay (operated by Nationwide TFS, LLC) to automate your plan payments to the Chapter 13 Trustee. TFS collects highly sensitive information directly from you, including your Social Security number, bank account and routing numbers, date of birth, and bankruptcy case details. Your use of TFS is governed by TFS’s own Terms of Service and Privacy Policy at https://www.tfsbillpay.com/privacy_policy. We are not responsible for TFS’s data practices. You should read their policies carefully before enrolling.
17. Chapter 13 Case Data and Trustee Platforms
Our firm accesses and submits information through several trustee-specific platforms in connection with Chapter 13 cases:
- NDC (National Data Center) — We access the NDC portal to monitor case payment history, disbursement records, and claims data sourced from the Chapter 13 Trustee’s office. Use is subject to NDC’s Privacy Policy at https://www.ndc.org/privacy-policy.
- Trustee13.com / TrustWin (Satori) — We use this secure portal to submit documents to the Chapter 13 Trustee’s office that are not required to be filed with the court.
- BKDocs.us — We use this encrypted file transfer service to securely transmit case documents to the Trustee’s office using public-key encryption technology.
By retaining our firm for Chapter 13 matters, you authorize us to access, submit, and receive case-related information through these platforms on your behalf as necessary to represent you.
18. Electronic Court Filings (CM/ECF)
Our firm files documents in federal court through the CM/ECF system, accessible to the public via PACER. By retaining our firm for federal court matters, you acknowledge:
- Court filings become public records — Documents filed through CM/ECF are entered into the permanent public court record, accessible through PACER.
- Redaction requirements — Federal rules (FRBP Rule 9037; FRCP 5.2) require redaction of SSNs (last four digits), financial account numbers (last four digits), dates of birth (year only), and names of minor children (initials only). Our firm complies with these requirements.
- Bankruptcy schedules — Financial schedules are filed as part of the public record. Significant financial and personal information will be publicly accessible through PACER upon filing.
- No removal from public record — Once docketed in CM/ECF, documents cannot be removed absent a specific court order.
If you have concerns about information that will appear in a court filing, raise them with your attorney before the filing is submitted.
19. Electronic Fax (eFax)
Our firm uses eFax, operated by Consensus Cloud Solutions, LLC, to send and receive faxes electronically. Fax transmissions may contain sensitive client documents and are encrypted by eFax using TLS 1.2 in transit and AES-256 at rest. Under eFax’s terms, our firm is the data controller and is responsible for the content of all fax transmissions and compliance with applicable laws, including the TCPA with respect to unsolicited faxes. Use of our fax services is subject to eFax’s Privacy Policy at https://www.efax.com/fax/privacy-policy.
20. Cloud Backup (afi.ai)
Our firm uses afi.ai to back up our Google Workspace and Microsoft 365 data, including email, documents, calendars, contacts, and Teams/SharePoint content. afi.ai is SOC 2 Type II certified, GDPR-compliant, and HIPAA-compliant. Backed-up data is encrypted with AES-256 and stored on Google Cloud Platform infrastructure in the United States. afi.ai uses your data solely to provide backup and recovery services. afi.ai’s Privacy Policy is available at https://afi.ai/privacy.
21. Intellectual Property
All content on this website, including text, graphics, logos, and images, is owned by or licensed to our firm and is protected by applicable intellectual property laws. You may not copy, reproduce, distribute, or create derivative works of any site content without our prior written consent.
22. Prohibited Uses
You agree not to use this Site or our services to:
- Violate any applicable local, state, national, or international law or regulation
- Submit false or misleading information
- Impersonate any person or entity, or misrepresent your affiliation
- Transmit unsolicited advertising or promotional materials
- Interfere with or disrupt the integrity or performance of the Site
- Attempt to gain unauthorized access to any portion of the Site or related systems
- Use the Site in any way that could damage, disable, overburden, or impair it
- Send phishing, smishing, social engineering, or other fraudulent communications
23. Disclaimer of Warranties
THIS WEBSITE AND ALL INFORMATION, CONTENT, AND SERVICES PROVIDED THROUGH IT ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
24. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE FIRM AND ITS ATTORNEYS, STAFF, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THIS SITE OR OUR SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING OUT OF OR RELATED TO YOUR USE OF THIS SITE SHALL NOT EXCEED $100.
Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities, so some of the above limitations may not apply to you.

27. Governing Law and Dispute Resolution
These Terms and any disputes arising out of or relating to them shall be governed by and construed in accordance with the laws of the State of New Jersey and Pennsylvania, without regard to conflict of law principles.
Any dispute shall first be submitted to our office for informal resolution. If unresolved, disputes shall be resolved through binding individual arbitration administered by the American Arbitration Association, unless you elect to bring your claim in small claims court. YOU AND THE FIRM AGREE TO BRING CLAIMS ONLY ON AN INDIVIDUAL BASIS AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS OR REPRESENTATIVE ACTION.
Either party may seek injunctive or other equitable relief in a court of competent jurisdiction to prevent irreparable harm pending arbitration.

31. Entire Agreement
These Terms, together with our Privacy Policy and any written engagement agreement, constitute the entire agreement between you and our firm regarding your use of this Site and supersede all prior understandings and agreements relating to the same subject matter.
