A. Information You Provide Directly

We collect personal information you voluntarily provide, which may include:

When you visit our website, we and our service providers automatically collect:

C. Cookies and Tracking Technologies

We use cookies, pixels, and similar tracking technologies on our website. Specifically:

D. Information from Our Client Portal

We use the MyCase Client Portal, operated by 8am, LLC (formerly AffiniPay/MyCase, Inc.), to manage client communications, documents, and payments. When you use the Portal, the information you submit is processed by MyCase on our behalf and is subject to the MyCase Privacy Policy available at https://www.8am.com/privacy-policy/.

E. Telephone Calls and Voicemail

We use Answerfirst, a professional answering service, to handle telephone calls. When you call our office, Answerfirst staff may collect your name, phone number, and the nature of your inquiry in order to route your call or relay a message to our firm.

For clients in bankruptcy or debt-related matters, we use Jubilee Pro (by LegalPRO Systems, Inc.) for case management and due diligence, and Stretto’s Debt Management Module (DMM) for mortgage modification and related services. These platforms process sensitive financial and legal information. Notably, Stretto’s services involving consumer financial data are subject to applicable provisions of the Fair Credit Reporting Act (FCRA) and the Gramm-Leach-Bliley Act (GLBA). G. Electronic Court Filings (CM/ECF and PACER)

For clients in federal court matters, our firm files documents electronically through the federal courts’ Case Management/Electronic Case Files (CM/ECF) system, administered by the Administrative Office of the U.S. Courts and accessible to the public via PACER (Public Access to Court Electronic Records). Please be aware of the following:

  • Court filings are public records — Documents filed through CM/ECF generally become part of the permanent public court record and are accessible to anyone through PACER.
  • Redaction of personal identifiers — Federal rules (FRBP Rule 9037 and FRCP 5.2) require that certain personal identifiers be redacted in public filings, including Social Security numbers (last four digits only), financial account numbers (last four digits only), birth dates (year only), and names of minor children (initials only). Our firm follows these requirements.
  • Bankruptcy schedules — In bankruptcy cases, your financial schedules and required disclosures are filed as part of the public record. We comply with applicable redaction rules, but significant financial and personal information becomes publicly accessible through PACER upon filing.
  • No control over public record — Once a document is accepted by the court and entered into CM/ECF, neither our firm nor you can remove it from the public record absent a specific court order.

Our attorneys use BriefCatch (by LawCatch, Inc.), a legal writing and editing tool that operates as a plugin within Microsoft Word and Outlook. BriefCatch does not store, retain, or log the text of any documents processed using the tool. Document text is processed in memory only and is not retained by BriefCatch. The only information BriefCatch retains is credential information such as the name and email address used to access the platform.


3. How We Use Your Information

We use the information we collect for the following purposes:

  • To provide legal services and manage your matter
  • To communicate with you via the Client Portal, telephone, email, or text message (SMS)
  • To process payments for legal services
  • To schedule consultations and appointments
  • To send transactional or administrative emails related to your representation
  • To send firm news, legal updates, or marketing emails where you have consented or where permitted by law
  • To solicit client reviews in compliance with applicable bar rules and FTC guidelines
  • To analyze website usage and improve our online presence
  • To measure the effectiveness of our advertising campaigns
  • To automate administrative workflows between our software platforms using Zapier
  • To administer bankruptcy cases, mortgage modifications, and debt management plans
  • To process Chapter 13 plan payments through TFS Bill Pay
  • To access and submit case information through trustee-linked platforms (NDC, Trustee13.com, BKDocs.us)
  • To back up and securely store firm and client data
  • To comply with legal, regulatory, and professional responsibility obligations
  • To protect the rights, safety, and security of our firm, our clients, and the public

4. How We Share Your Information

A. We Do Not Sell Your Data

We do not sell, trade, or rent your personal information to third parties for their own commercial purposes, and we never have. This applies to all information we collect, including information about our website visitors and our clients.

B. Service Providers

We share information with trusted third-party service providers that help us operate our firm and deliver our services. Each provider is contractually required to protect your information and may only use it for the specific purpose for which it was shared.

We may disclose your information when required by law, court order, subpoena, or other legal process. All disclosures of client information are also governed by our professional responsibility obligations under the rules of professional conduct of New Jersey and Pennsylvania and the attorney-client privilege.

D. Business Transfers

In the event of a merger, acquisition, or sale of our practice, your information may be transferred to a successor firm, subject to equivalent privacy protections.


5. Text Message (SMS) Communications

Law Office of Mike Assad, P.C. SMS Messaging. We use text messaging (SMS) through the MyCase platform, which is powered by Twilio, Inc., to send clients case updates, appointment reminders, and other communications related to your representation.

  • Consent — By providing your mobile number and agreeing to receive texts, you consent to receive text messages from or on behalf of our firm, which may include autodialed or prerecorded messages. We will not send marketing texts without your prior express written consent.
  • No sharing of mobile data for marketing — Mobile phone numbers collected for SMS communications and SMS opt-in consent will never be shared with third parties or affiliates for marketing or promotional purposes. This is a firm and unconditional policy.
  • Message frequency — Varies based on the status of your matter and your preferences.
  • Message and data rates — Standard rates from your wireless carrier may apply. We are not responsible for any carrier charges.
  • To opt out — Reply STOP to any message we send, or contact us at mike@assad.law or 609-808-3300. After opting out you will receive one confirmation message and no further non-essential texts.
  • Help — Reply HELP to any message or contact us at mike@assad.law.
  • Carrier disclaimer — Carriers are not liable for delayed or undelivered messages.
  • Compliance — Our SMS practices comply with the TCPA and Twilio’s Messaging Policy, Terms of Service, and Acceptable Use Policy.

6. Email Communications

A. Transactional Email

We send transactional and administrative emails related to your matter using Postmark, a transactional email service. These emails are necessary for the administration of our services and are not marketing communications.

B. Marketing Email (Mailchimp)

We may send firm news, legal updates, and other marketing communications to individuals who have opted in. Every marketing email includes an unsubscribe link. You can opt out at any time by clicking that link or contacting us at mike@assad.law. Our marketing email practices comply with the CAN-SPAM Act.


Our firm uses Mailsuite (also known as Mailtrack), a Gmail plugin developed by Mailsuite S.L., to track when outgoing emails are opened and when links within emails are clicked. This tool operates by embedding a small, invisible tracking pixel in emails sent from our Gmail accounts. When you open an email from us that contains this pixel, Mailsuite’s servers log the following information:

  • That the email was opened, and the number of times it was opened
  • The approximate time and date of each open
  • Your IP address and general geographic location at the time of opening
  • Device and browser information
  • Whether any links in the email were clicked

This information is used solely by our firm to manage client communications, confirm receipt of important correspondence, and follow up on time-sensitive matters. We do not use this data for advertising or sell it to third parties.

Mailsuite does not access, store, or share the content of your emails. All data is encrypted with AES-256 and stored on AWS infrastructure. Mailsuite is GDPR-compliant and undergoes annual security audits by Google. Mailsuite’s Privacy Policy is available at https://mailsuite.com/en/privacy-and-security-center.

If you prefer that your email opens not be tracked, you can disable image loading in your email client, which will prevent the tracking pixel from loading.


8. Video Conferencing and Recording

We use Zoom and Google Meet for video consultations and meetings. Please be aware:

  • Meetings may be recorded with prior notice to participants. We will notify you before recording any session.
  • Zoom and Google collect certain data about participants, including name, email, IP address, and device information, per their respective privacy policies.
  • Review Zoom’s Privacy Policy (https://explore.zoom.us/en/privacy/) and Google’s Privacy Policy (https://policies.google.com/privacy) for details.

9. Document Delivery and Tracking (DocSend)

We may use DocSend to securely deliver documents to you. DocSend tracks whether and how recipients engage with delivered documents (such as whether a document was opened and for how long). By receiving a document through DocSend, you acknowledge that basic document engagement data may be collected.


10. Review Solicitation (Reputation Stacker)

We may use Reputation Stacker to request that clients leave reviews on platforms such as Google or Avvo. We share only your name and email address with Reputation Stacker for this sole purpose. This is done in compliance with applicable bar rules and FTC guidelines on endorsements and testimonials. You are under no obligation to leave a review.


11. Apple iMessage and FaceTime

Our attorneys may communicate with clients via Apple iMessage and FaceTime. These services use end-to-end encryption, meaning Apple cannot read message content or listen to FaceTime calls. Apple does collect certain metadata (such as your Apple ID, device information, and connection data) in accordance with its Privacy Policy at https://www.apple.com/legal/privacy/. If you communicate with us via iMessage or FaceTime, you acknowledge that Apple’s privacy practices govern those communications at the platform level.


12. Chapter 13 Payment Processing (TFS Bill Pay)

For clients in Chapter 13 bankruptcy, our firm may direct you to use TFS Bill Pay (operated by Nationwide TFS, LLC) as your automated payment solution for making plan payments to the Chapter 13 Trustee. Please be aware that TFS collects highly sensitive personal and financial information directly from you, including:

  • Full name, address, email address, and telephone number
  • Social Security number and date of birth
  • Bank account number and routing number
  • Bankruptcy case number, district, and attorney information
  • Transaction history and payment records

This information is collected and processed by TFS directly and is subject to TFS’s own Privacy Policy at https://www.tfsbillpay.com/privacy_policy. TFS shares your information with the Chapter 13 Trustee assigned to your case and with third-party service providers necessary to process payments. TFS does not sell or rent your information. You should read TFS’s Privacy Policy carefully before enrolling in their payment service.


13. Chapter 13 Case Data (NDC — National Data Center)

Our firm uses the National Data Center (NDC), a comprehensive data portal maintained in coordination with participating Chapter 13 Trustee offices, to access up-to-date case information including payment history, disbursement records, and claims data. NDC is updated daily with data sourced directly from the Trustees’ offices. Information accessible through NDC relates to your bankruptcy case record and is subject to NDC’s Privacy Policy at https://www.ndc.org/privacy-policy.


14. Trustee Document Submission (Trustee13.com / TrustWin and BKDocs.us)

Our firm submits documents to Chapter 13 Trustee offices through two secure platforms:

  • Trustee13.com / TrustWin (by Satori) — A secure web portal used to submit case documents to the Chapter 13 Trustee’s office that are not required to be filed with the court. Access is credentialed and case-specific.
  • BKDocs.us — An encrypted file transfer service that uses public-key encryption technology to securely transmit documents directly to the Trustee’s case management system. BKDocs.us integrates with TrustWin and other trustee software platforms.

Documents submitted through these platforms may include case-specific financial documents, correspondence, and other materials related to your bankruptcy matter. These submissions are made in furtherance of our legal representation of you and are transmitted only to the applicable Trustee’s office.


15. Workflow Automation (Zapier)

We use Zapier to automate workflows and data transfers between some of our software platforms. When Zapier is used, it may temporarily process data that passes between connected applications. Zapier’s Privacy Policy is available at https://zapier.com/privacy. We configure our Zapier workflows to limit data exposure to only what is necessary for each automated task.


16. Scheduling (Calendly)

We use Calendly (or Acuity Scheduling) for online appointment booking. When you schedule a consultation, Calendly collects your name, email address, phone number, and availability. Calendly’s Privacy Policy is available at https://calendly.com/privacy.


17. Electronic Fax (eFax)

Our firm uses eFax, a digital fax service operated by Consensus Cloud Solutions, LLC, to send and receive faxes electronically. Unlike a traditional fax machine, eFax routes fax transmissions over the internet and may temporarily store fax content on Consensus’s servers during transmission. Please be aware of the following:

  • Content transmitted via fax — Documents sent to or received from our firm via fax may contain sensitive personal and legal information. eFax uses TLS 1.2 encryption in transit and AES-256 encryption for stored fax data.
  • You are the data controller — Under eFax’s terms, our firm is responsible for obtaining any consents required in connection with fax transmissions, including TCPA compliance for outbound faxes.
  • Retention — eFax may retain fax records in accordance with its Privacy Policy. Our firm retains copies of faxes as part of client files in accordance with our data retention policy.

18. Cloud Backup (afi.ai)

In addition to Backblaze and AWS, our firm uses afi.ai to back up our Google Workspace and Microsoft 365 data, including email, documents, calendars, contacts, and Teams/SharePoint content. afi.ai is:

  • SOC 2 Type II certified, GDPR-compliant, and HIPAA-compliant (can sign a BAA upon request)
  • Hosted on Google Cloud Platform (GCP) in the United States
  • Protected by AES-256 encryption at rest and TLS in transit
  • Operated under a least-privilege access model

afi.ai uses your data solely to provide backup and recovery services. afi.ai’s Privacy Policy is available at https://afi.ai/privacy.


19. Data Storage and Security

We take the security of your information seriously and use technical, administrative, and physical safeguards to protect it:

  • Cloud storage — Documents stored in Google Drive, Microsoft 365, and Dropbox with industry-standard encryption.
  • Website infrastructure — Hosted by DreamHost and protected by Cloudflare (CDN, DDoS protection, SSL/TLS encryption).
  • Cloud backup — Firm data backed up using afi.ai (Google Workspace and Microsoft 365), Backblaze, and/or AWS, all with strong encryption and relevant security certifications.
  • Electronic fax — Faxes sent and received via eFax are encrypted using TLS 1.2 in transit and AES-256 at rest on Consensus Cloud Solutions’ servers.
  • Legal writing tools — BriefCatch uses AES-256 encryption at rest and TLS 1.3 in transit, is SOC 2 certified, and does not retain document text.
  • Trustee platforms — TFS Bill Pay uses 128/256-bit SSL encryption; BKDocs.us uses public-key encryption for all document transfers.

Despite these measures, no method of Internet transmission or electronic storage is 100% secure. If you believe there has been unauthorized access to your information, please contact us immediately.


20. Data Retention

We retain personal information for as long as necessary to fulfill the purposes described in this Policy and to comply with our legal, ethical, and regulatory obligations. Attorney-client records are retained in accordance with applicable New Jersey and Pennsylvania state bar guidelines and professional rules of conduct. When we no longer need your information, we dispose of it securely.


21. Your Rights and Choices

Depending on your state of residence, you may have certain rights with respect to your personal information, including:

  • The right to know what personal information we hold about you and how it is used
  • The right to request correction of inaccurate information
  • The right to request deletion of your information (subject to our legal retention obligations)
  • The right to opt out of marketing emails or text messages
  • The right to opt out of certain online tracking and advertising

22. California Privacy Rights (CCPA/CPRA)

If you are a California resident, you have additional rights under the CCPA as amended by the CPRA, including the right to know, delete, correct, and opt out of the sale or sharing of personal information, and the right to non-discrimination for exercising these rights. We do not sell or share your personal information for third-party commercial purposes. Contact us at mike@assad.law to submit a request; we will respond within 45 days.


23. Third-Party Directories and Platforms

Our firm maintains profiles on Avvo, FindLaw, Martindale-Hubbell, Yelp, and Facebook. These platforms independently collect data about visitors to our profiles and are governed by their own privacy policies. We are not responsible for their data practices.


24. Children’s Privacy

Our website and services are not directed to children under 13. We do not knowingly collect personal information from children under 13. If you believe we have inadvertently done so, please contact us and we will promptly delete it.


25. Changes to This Privacy Policy

We may update this Policy from time to time. When we make changes, we will update the “Last Updated” date at the top of this page. Your continued use of our website or services after any changes constitutes acceptance of the updated Policy.
