Common questions
We're right around the state median income. Doesn't that rule out Chapter 7?
No. The means test is a comparison against the median for your specific household size, followed by a hard look at what you actually spend to keep the household running, so a family at or even somewhat above the median can still qualify. And when Chapter 7 isn't the fit, Chapter 13 usually is.
Would a Virtua bill from my daughter's birth be wiped out if we file?
Hospital and physician balances are unsecured debt, so Chapter 7 generally discharges them in full. In Chapter 13 they're typically paid only in part through the plan, with the remainder discharged at the end. Bills that have already gone to collections or judgment are treated the same way.
