Common questions about Loan Modifications

What is a loan modification?

It is a permanent change to the terms of your existing mortgage, such as a lower interest rate, a longer term, or moving your past-due balance to the end of the loan, so your monthly payment becomes affordable again. You keep the same loan and the same home.

Is this the same as refinancing?

No. A refinance replaces your loan with a brand new one and usually requires good credit and equity. A modification changes the loan you already have, which is why it can work even when a refinance is out of reach.

Will it stop a foreclosure?

Not by itself, and be careful with anyone who suggests otherwise. Applying doesn't legally stop a sale. What a complete application does, if it's in more than 37 days before the sale date, is bar the servicer from moving for judgment or selling while the review is pending. If a sheriff sale is close, filing Chapter 13 generally stops it immediately under the automatic stay, and we can finish the modification from that safety.

Do I have to file bankruptcy to get one?

No. Many modifications are negotiated directly with the lender. We pursue the modification on its own when that is the cleanest fix, and combine it with bankruptcy only when that gets you a better, more certain result.

Should I get a loan modification or file Chapter 13?

They solve different problems, and they can be sequenced. A modification keeps your existing loan on new terms, which works when the servicer approves and the new payment fits your budget. Chapter 13 doesn't need the lender's agreement: you catch up the missed payments over 3 to 5 years under court protection while keeping the regular payment going. I just fell behind. How soon can foreclosure actually start?

Under federal servicing rules, a servicer generally can't make the first foreclosure filing until you're more than 120 days delinquent. That window is the best time to get a complete modification application in. Two cautions: the rule only covers the first filing, so it won't pause a foreclosure that's already underway, and an incomplete application gets much weaker protection. Don't sit on it.
